Terms of service

1. The service
EconoWatt Intelligence (“EconoWatt,” “we”), based in Quito, Ecuador, provides a smart energy monitoring and management service comprising: metering devices installed at the customer's premises, a web platform for visualization and analysis, and alerts, reports and insights generated with the support of artificial intelligence. By contracting the service, you accept these terms.
2. Plans, pricing and payments
The service is provided under the plans and rates published on this website or agreed in writing. Published prices do not include VAT. The installation fee is a one-time payment per monitoring point, covering the technical work, materials and commissioning. The monthly fee is billed in advance. Non-payment may lead to suspension of the service after prior notice.
3. Equipment on loan
The metering devices are and remain at all times the property of EconoWatt, provided to the customer on loan (loan for use) while the service is active. The customer agrees to: (a) not tamper with, alter or remove the equipment; (b) immediately report any damage or anomaly; and (c) allow reasonable, coordinated access for maintenance or removal. Upon termination of the service, EconoWatt will remove the equipment at no cost to the customer, in a coordinated visit.
4. Term and termination
The service has an annual commitment with automatic renewal for equal periods, unless either party gives notice at least 30 days in advance. The customer may terminate the service with no exit penalty; termination takes effect at the close of the current monthly period, with coordinated removal of the equipment. EconoWatt may terminate the service for breach of these terms or for supervening technical impossibility, with prior notice.
5. Installation and customer obligations
The customer will provide access to the premises and to the electrical panels at the coordinated times, and warrants that its electrical installation meets minimum safety conditions. Installation is carried out by qualified technical personnel. If the customer's installation presents unsafe conditions that prevent the work, a solution will be coordinated before proceeding.
6. Nature of the service and limits
EconoWatt is a monitoring, information and analysis tool. The service does NOT replace: (a) professional electrical maintenance of the customer's installation; (b) the electrical protections required by regulation; or (c) the advice of an electrical professional for interventions in the installation. The alerts, reports and insights —including those generated by artificial intelligence— are supporting information for the customer's decision-making, not guarantees of results. Savings and improvements depend on the decisions and actions the customer adopts. Power quality measurement capabilities depend on the type of meter installed. EconoWatt facilitates monitoring and management in line with the parameters of the technical standards referenced on this site; formal certification under any standard is the remit of accredited bodies.
7. Availability
EconoWatt makes reasonable efforts to keep the service continuously available. The service depends on external factors such as the electricity supply and the internet connectivity of the customer's premises, so uninterrupted availability is not guaranteed. Interruptions attributable to such external factors do not constitute a breach by EconoWatt.
8. Customer data
The consumption data generated by monitoring the customer's business belongs to the customer. EconoWatt processes it in accordance with the Privacy Policy, including the possibility of using aggregated and anonymized data that does not identify the customer. While the service is active, the customer can access their data through the platform and request exports according to their plan.
9. Intellectual property
The platform, the software, the analytics models, the trademarks and the contents of EconoWatt are the property of EconoWatt or its licensors. The service grants the customer a limited, non-exclusive and non-transferable license to use them for the duration of the contract.
10. Liability
To the maximum extent permitted by law, EconoWatt's total liability to the customer for any claim arising from the service is limited to the amount paid by the customer in the 12 months prior to the event giving rise to the claim. EconoWatt is not liable for indirect damages or lost profits.
11. Modifications
EconoWatt may update these terms by publishing the current version on this page. Substantial changes will be communicated to active customers with reasonable advance notice. Continued use of the service after they take effect implies acceptance.
12. Governing law
These terms are governed by the laws of the Republic of Ecuador. Any dispute will be submitted to the competent courts of the customer's domicile or of Quito, at the choice of the party bringing the action.
